The Medical Review Panel

Indiana medical malpractice lawsuits are under the jurisdiction of the Indiana Medical Malpractice Act.  Medical malpractice claims are evaluated by a medical review panel before any claim can be made in court.  The process can become complicated, so it is especially important to work with an experienced medical malpractice attorney.  Steps include—

  • A proposed medical malpractice complaint is filed with the state insurance department.
  • A medical review panel is then formed.
  • The panel reviews submissions and delivers an opinion as to whether the evidence supports the plaintiff's complaint.
  • The medical review panel gives an opinion, but this does not decide the case.
  • It is only after the medical review panel has reached its opinion that you have the right to file a lawsuit.
