On Behalf of | May 21, 2021 | divorce

Having kids share two homes is hard enough, but if you think that your ex-spouse may take off with them and not let you see them anymore, then you do need to take steps to stop that from happening.

Whether they’ve threatened to withhold custody or you find out that they got your children passports without your knowledge, it’s smart to talk to your attorney about your options as soon as possible. There are some red flags to watch out for, and your attorney can help you address them.

What are some red flags that your ex may flee with your kids?

There are some signs that your ex may kidnap your children. These may include:

  • Getting your children passports without your knowledge, which may be a sign that they’re planning to take your children out of the country
  • Suddenly cashing out retirement or other large funds
  • Having no local support from family or friends as well as nothing to tie them to the area

These are just a few of many signs that your ex may be planning to take your children away.

What can you do if you think your ex-spouse is going to kidnap your children?

If you believe that your ex-spouse is going to kidnap your children, there are some steps to take right away.

First, collect evidence. For example, if you have a custody agreement that states that they cannot take your children out of state but you discovered that they purchased flights, call your attorney will that information right away. If your child mentions that they had their picture taken at the post office or that they just got a set of luggage, then that may be something to look into as well.

Next let your attorney know that you’d like to take steps to prevent them from leaving. You may be able to seek a modification of the current custody agreement or have other temporary orders put into place to prevent your children from leaving the state or country.

This is a frightening scenario to consider, but by taking action, you may be able to prevent parental kidnapping from taking place.
